Please read these Terms of Service carefully before accessing our website, creating an account, participating in one of our programs, or purchasing any product.
These Terms of Service (“Terms”) constitute a legally binding agreement between you and First Choice Peptides (“First Choice Peptides,” “Company,” “we,” “our,” or “us”). These Terms govern your access to and use of Firstchoicepeptides.com, including its content, customer accounts, communications, affiliate programs, products, features, and related services, collectively referred to as the “Website” or “Services.”
By accessing the Website, creating an account, placing an order, participating in an affiliate or referral program, or otherwise using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, you must not access or use the Website, create an account, participate in our programs, or purchase products from First Choice Peptides.
1. Eligibility and Authority
You must be at least twenty-one (21) years old and legally capable of entering into a binding agreement to access our Services or purchase products from First Choice Peptides.
By using the Website, you represent and warrant that:
- You are at least 21 years of age;
- The information you provide is truthful, complete, and current;
- You are legally permitted to access the Website and purchase the products offered;
- You will comply with all applicable federal, state, local, and other laws and regulations; and
- You will use our products exclusively for lawful laboratory research purposes.
If you use the Website on behalf of a company, laboratory, institution, or other organization, you represent and warrant that you have the authority to bind that organization to these Terms. In such cases, “you” includes both you and the organization you represent.
2. Qualified Research Customers
Access to our products is intended for qualified researchers, laboratory professionals, research institutions, and organizations engaged in legitimate scientific or analytical research.
First Choice Peptides may, at its discretion:
- Request information concerning your research qualifications, intended use, or institutional affiliation;
- Require additional identity, age, payment, or order verification;
- Refuse to establish or continue a customer relationship;
- Limit the products or quantities available to a customer;
- Place an order on hold pending verification;
- Cancel an order; or
- Suspend or terminate an account when satisfactory verification is not provided.
Acceptance of a prior order does not obligate First Choice Peptides to accept future orders.
3. Products and Research Use Only
All products sold by First Choice Peptides are supplied strictly for lawful laboratory research and in-vitro research purposes only.
Our products are not intended for:
- Human consumption;
- Animal consumption;
- Human or veterinary administration;
- Diagnostic procedures;
- Therapeutic or clinical use;
- Compounding or pharmaceutical preparation;
- Cosmetic or food applications;
- Household use;
- The diagnosis, treatment, cure, mitigation, or prevention of any disease; or
- Any use that has not been expressly authorized by applicable law.
No product, statement, description, image, article, Certificate of Analysis, scientific reference, customer communication, or other Website content constitutes medical advice, veterinary advice, dosing guidance, treatment advice, or a recommendation that any product be administered to or used by any human or animal.
By purchasing a product, you represent, warrant, acknowledge, and agree that:
- You are purchasing the product solely for legitimate laboratory research;
- You possess the knowledge, training, facilities, equipment, and safeguards reasonably necessary to handle the product;
- You will not ingest, inject, inhale, apply, administer, compound, prescribe, distribute, or otherwise use the product in or on any human or animal;
- You will not provide the product to another person for human or animal use;
- You will store, handle, document, transport, and dispose of the product safely and lawfully;
- You will independently determine whether the product is suitable for your intended research;
- You will comply with all applicable laws, regulations, institutional policies, safety procedures, and industry standards; and
- You will not rely on First Choice Peptides for medical, veterinary, clinical, legal, regulatory, or laboratory-safety advice.
We may refuse or cancel an order if we suspect that a product may be used inconsistently with these Terms.
4. Regulatory and Scientific Information
Statements on the Website have not necessarily been reviewed or approved by the United States Food and Drug Administration or any other regulatory authority.
References to scientific literature, research findings, molecular characteristics, testing data, purity, identity, stability, or possible areas of study are provided only for general informational and research-related purposes.
Such information does not:
- Establish that a product is safe or effective;
- Authorize human or veterinary use;
- Guarantee a particular research outcome;
- Replace independent testing or validation;
- Constitute regulatory approval; or
- Create a warranty regarding a particular application.
You are responsible for independently evaluating all information before relying upon it for laboratory research.
5. Customer Accounts
You may be permitted or required to create an account to place orders, view order information, or access certain Website features.
You agree to:
- Provide accurate and complete account information;
- Keep your information current;
- Maintain the confidentiality of your username and password;
- Prevent unauthorized access to your account; and
- Notify us promptly if you suspect unauthorized access or a security incident involving your account.
You are responsible for activities conducted through your account to the extent permitted by applicable law.
We may suspend, restrict, or terminate an account that contains inaccurate information, appears compromised, violates these Terms, or presents a legal, security, fraud, payment, or operational risk.
6. Orders and Acceptance
Submitting an order constitutes an offer to purchase and does not guarantee that the order will be accepted.
All orders are subject to:
- Product availability;
- Payment authorization;
- Identity and age verification;
- Review for compliance with these Terms;
- Shipping restrictions;
- Fraud screening; and
- Final acceptance by First Choice Peptides.
We reserve the right, to the extent permitted by applicable law, to:
- Accept, reject, limit, place on hold, or cancel an order;
- Limit purchase quantities;
- Decline service to a customer;
- Correct pricing, product, inventory, or descriptive errors;
- Discontinue or modify products;
- Request additional verification; or
- Cancel transactions that appear suspicious, unlawful, fraudulent, or inconsistent with legitimate research use.
If we cancel an order after collecting payment, we will return the applicable amount to the original payment method, subject to payment-provider processing times.
7. Pricing, Taxes, and Payment
Prices are stated in U.S. dollars unless otherwise indicated and may change without notice.
You agree to pay:
- The product price displayed when your order is submitted;
- Applicable shipping and handling charges;
- Applicable taxes; and
- Any other charges clearly disclosed before checkout.
By providing a payment method, you represent that you are authorized to use it and authorize us and our payment providers to charge the total order amount.
We may correct pricing or calculation errors even after an order is submitted. If a material error affects an order, we may cancel the order and issue a refund or contact you for authorization to proceed at the corrected price.
Full payment-card information is processed by third-party payment providers and is handled according to their applicable terms and privacy practices.
8. Shipping and Delivery
We currently ship only to eligible addresses within the United States unless otherwise stated on the Website.
Shipping and delivery dates are estimates and are not guaranteed. Delays may occur because of carrier operations, weather, service interruptions, incorrect addresses, payment review, legal restrictions, natural events, or circumstances beyond our reasonable control.
You are responsible for providing a complete and accurate shipping address. We are not responsible for delivery failures, losses, or additional costs caused by incorrect or incomplete information provided by you.
To the extent permitted by applicable law, title and risk of loss pass in accordance with the shipping terms disclosed at checkout and applicable carrier arrangements.
You are responsible for promptly inspecting your delivery and following all applicable storage instructions.
9. Returns, Damage Claims, and Replacements
Purchases are subject to our separate Return and Refund Policy, which is incorporated into these Terms by reference.
Unless otherwise required by law or expressly stated in that policy:
- Sales are final;
- Returns or refunds are not provided for a change of mind, dissatisfaction, improper use, improper storage, improper handling, or unsuccessful research outcomes;
- Products that have been opened, reconstituted, altered, contaminated, improperly stored, or otherwise handled after delivery are not eligible for return or replacement;
- Damage claims must be submitted within the period stated in our Return and Refund Policy;
- Claims must include clear photographic evidence of the product, packaging, shipping label, and alleged damage;
- Damage claims are subject to investigation and approval; and
- An approved transit-damage claim may qualify for one replacement of the affected product.
A replacement is not an admission of fault or liability.
First Choice Peptides is not responsible for degradation, contamination, loss, damage, or changes occurring after delivery due to storage conditions, handling, reconstitution, laboratory procedures, transfer, or other actions outside our control.
10. Product Inspection, Storage, and Handling
You are solely responsible for inspecting products upon delivery and maintaining appropriate laboratory controls.
You agree to:
- Review available labeling and documentation;
- Follow reasonable laboratory-safety procedures;
- Restrict access to qualified personnel;
- Maintain appropriate temperature, light, humidity, contamination, and security controls;
- Avoid cross-contamination;
- Use appropriate personal protective equipment;
- Maintain appropriate records; and
- Dispose of products and related materials in accordance with applicable laws and institutional procedures.
First Choice Peptides is not responsible for any product change, deterioration, contamination, or loss resulting from events occurring after delivery.
11. Certificates of Analysis
A Certificate of Analysis (“COA”) may be available for certain products or batches.
A COA reflects the results reported for the sample and testing conditions identified in that document at the time testing was performed.
A COA does not:
- Guarantee future stability;
- Guarantee that every unit will remain unchanged after testing or delivery;
- Establish suitability for a particular research method;
- Constitute approval for human or veterinary use;
- Replace independent testing by the customer; or
- Create a warranty beyond any warranty that cannot lawfully be disclaimed.
Customers are responsible for reviewing the applicable batch information and conducting any additional testing necessary for their research requirements.
12. Prohibited Conduct
You must not:
- Use the Website or any product for an unlawful purpose;
- Purchase or use a product for human or animal consumption or administration;
- Request, provide, publish, or promote human or animal dosing instructions;
- Represent a product as a drug, medicine, dietary supplement, cosmetic, food, therapeutic agent, veterinary product, or consumer product;
- Make claims that a product diagnoses, treats, cures, mitigates, or prevents a disease;
- Misrepresent your identity, age, qualifications, affiliation, intended use, or payment authority;
- Provide false, misleading, or incomplete information;
- Resell, redistribute, relabel, repackage, or export products without our prior written authorization and all legally required permissions;
- Remove, conceal, or alter product labels, warnings, notices, or identifiers;
- Use our name, trademarks, images, or product materials to promote unauthorized uses;
- Interfere with Website operation or security;
- Introduce malware, malicious code, automated attacks, or harmful technology;
- Attempt to obtain unauthorized access to accounts, systems, or data;
- Scrape, crawl, harvest, copy, or extract Website content through automated methods without written authorization;
- Reverse engineer or circumvent Website controls;
- Impersonate First Choice Peptides or another person;
- Use the Website to harass, defraud, threaten, or harm others; or
- Assist another person in engaging in prohibited conduct.
Prohibited conduct may result in order cancellation, account suspension or termination, loss of program eligibility, refusal of future service, preservation of relevant records, and referral to payment providers, carriers, regulators, or law-enforcement authorities when appropriate.
13. Suspension and Termination
We may suspend or terminate your account, cancel pending orders, refuse future service, or restrict access to the Website if we reasonably believe that:
- You violated these Terms;
- Information you provided is false or unverifiable;
- Your use presents a safety, legal, regulatory, fraud, payment, security, or reputational risk;
- You are using or promoting products for unauthorized purposes;
- You failed to provide requested verification;
- Your conduct harms or threatens First Choice Peptides, another customer, or a third party; or
- Suspension or termination is otherwise reasonably necessary to protect our operations.
Termination does not affect obligations or liabilities that arose before termination.
Provisions that by their nature should survive termination—including intellectual-property, assumption-of-risk, warranty-disclaimer, limitation-of-liability, indemnification, dispute-resolution, and privacy provisions—will survive.
14. Affiliate and Referral Programs
First Choice Peptides may offer an affiliate, ambassador, rewards, or referral program (“Program”). Participation is subject to these Terms and any additional Program rules we provide.
We may establish or change:
- Eligibility requirements;
- Commission rates;
- Attribution methods;
- Qualifying transactions;
- Payout thresholds;
- Payment schedules;
- Promotional restrictions; and
- Program availability.
Affiliate commissions are payable only on valid, completed, qualifying transactions.
Transactions may be excluded, reversed, withheld, or charged back when associated with refunds, cancellations, duplicate referrals, self-referrals, fraudulent activity, prohibited advertising, regulatory risk, or violation of Program rules.
Affiliates must:
- Clearly and conspicuously disclose their material relationship with First Choice Peptides;
- Comply with applicable advertising, endorsement, marketing, privacy, and electronic-communications laws;
- Describe products exclusively as laboratory research products;
- Avoid medical, therapeutic, weight-loss, bodybuilding, dosing, human-use, or animal-use claims;
- Avoid false, misleading, unsubstantiated, or unauthorized statements;
- Obtain all legally required permissions before sending commercial email;
- Avoid bidding on restricted brand terms when prohibited by Program rules;
- Avoid impersonating First Choice Peptides or suggesting that an independent affiliate page is an official Company page; and
- Promptly remove or correct content at our request.
Affiliates act as independent contractors and have no authority to bind First Choice Peptides, make warranties on our behalf, or represent themselves as employees, partners, agents, or legal representatives of the Company.
We may suspend or terminate Program participation and withhold commissions reasonably connected to suspected fraud, prohibited conduct, chargebacks, violations, or transactions that do not qualify under the Program rules. Any forfeiture remains subject to applicable law.
Program participants agree to indemnify First Choice Peptides as provided in these Terms for claims arising from their advertising, statements, conduct, or Program activities.
15. Intellectual Property
The Website and its contents—including text, graphics, trademarks, logos, photographs, product images, illustrations, videos, data, software, layout, compilation, and design—are owned by or licensed to First Choice Peptides and are protected by applicable intellectual-property laws.
Subject to these Terms, we grant you a limited, revocable, nonexclusive, nontransferable right to access the Website for its intended purpose.
You may not, without our prior written authorization:
- Copy, reproduce, republish, distribute, sell, license, or commercially exploit Website content;
- Modify or create derivative works;
- Use our trademarks, trade names, branding, or product imagery;
- Frame, mirror, or embed Website content;
- Remove copyright, trademark, or proprietary notices; or
- Use Website materials to market unauthorized products or uses.
No right, title, or interest is transferred to you except for the limited access right expressly stated above.
16. Feedback and Submissions
When you voluntarily provide feedback, suggestions, ideas, product reviews, or other nonconfidential submissions, you grant First Choice Peptides a nonexclusive, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, modify, publish, display, distribute, and incorporate the submission for lawful business purposes.
You represent that you have the right to provide the submission and that our permitted use will not violate another person’s rights.
This provision does not authorize us to use personal information inconsistently with our Privacy Policy or applicable law.
17. Third-Party Services and Links
The Website may use or link to third-party services, including payment processors, carriers, hosting providers, analytics services, social platforms, or external websites.
Third-party services are governed by their own terms and privacy practices. First Choice Peptides does not control and is not responsible for third-party content, availability, security, products, actions, or privacy practices.
A link or integration does not constitute an endorsement.
18. Privacy and Customer Information
Our collection, use, disclosure, retention, and protection of personal information are governed by our Privacy Policy, which is incorporated into these Terms by reference.
We may process customer information as reasonably necessary to:
- Operate and secure the Website;
- Create and maintain accounts;
- Process payments;
- Review, fulfill, and deliver orders;
- Provide customer service;
- Detect and prevent fraud;
- Maintain business and transaction records;
- Analyze and improve our operations;
- Send communications permitted by law;
- Comply with legal obligations; and
- Complete a merger, financing, acquisition, restructuring, bankruptcy, or sale of assets.
We may use aggregated or de-identified information for lawful business, analytical, security, and research purposes, provided such information is handled in accordance with applicable law.
Nothing in these Terms grants us the right to disregard our Privacy Policy or any non-waivable privacy right.
19. Email Communications
We may send transactional emails concerning orders, accounts, security, customer service, policy updates, and other Services you request.
Where permitted by law or with your consent, we may also send promotional emails.
You may unsubscribe from promotional emails using the unsubscribe mechanism included in those messages.
Unsubscribing from promotional emails does not prevent us from sending nonmarketing communications concerning active orders, account security, legal notices, policy notices, or requested customer service.
20. Assumption of Risk
You acknowledge that research products may require specialized knowledge, equipment, facilities, controls, and safety procedures.
To the fullest extent permitted by law, you knowingly and voluntarily assume the risks associated with the possession, transportation, storage, handling, testing, transfer, disposal, and use of products purchased from First Choice Peptides.
These risks include risks arising from:
- Improper handling or storage;
- Contamination or cross-contamination;
- Degradation or instability;
- Laboratory error;
- Inadequate equipment or controls;
- Unauthorized access;
- Mislabeling or transfer;
- Unlawful or prohibited use; and
- Application to or use by any human or animal.
You remain solely responsible for your research procedures and for determining whether your personnel, facilities, methods, and safeguards are appropriate.
Nothing in this section waives liability that cannot lawfully be waived.
21. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE, SERVICES, CONTENT, AND PRODUCTS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.
FIRST CHOICE PEPTIDES DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, AND WARRANTIES ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE.
WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT:
- THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS;
- WEBSITE INFORMATION WILL ALWAYS BE COMPLETE, ACCURATE, OR CURRENT;
- A PRODUCT WILL SATISFY A PARTICULAR RESEARCH REQUIREMENT;
- A PRODUCT WILL PRODUCE A PARTICULAR RESULT;
- PRODUCT CHARACTERISTICS WILL REMAIN UNCHANGED AFTER DELIVERY;
- A COA WILL ESTABLISH SUITABILITY FOR A CUSTOMER’S PARTICULAR APPLICATION; OR
- THIRD-PARTY SERVICES WILL BE AVAILABLE OR ERROR-FREE.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS. IN SUCH JURISDICTIONS, THESE DISCLAIMERS APPLY ONLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.
22. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FIRST CHOICE PEPTIDES AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, SUPPLIERS, LICENSORS, SUCCESSORS, AND ASSIGNS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO:
- THE WEBSITE OR SERVICES;
- A PRODUCT OR ORDER;
- WEBSITE INFORMATION;
- SHIPPING OR DELIVERY DELAYS;
- LOSS OR CORRUPTION OF DATA;
- LOST PROFITS OR BUSINESS INTERRUPTION;
- RESEARCH OUTCOMES;
- UNAUTHORIZED ACCESS;
- PRODUCT STORAGE, HANDLING, TRANSFER, OR DISPOSAL;
- PRODUCT MISUSE; OR
- HUMAN OR ANIMAL USE.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO A PRODUCT, ORDER, OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID TO FIRST CHOICE PEPTIDES FOR THE SPECIFIC PRODUCT OR ORDER GIVING RISE TO THE CLAIM.
THESE LIMITATIONS APPLY REGARDLESS OF THE FORM OR THEORY OF LIABILITY, INCLUDING CONTRACT, WARRANTY, TORT, NEGLIGENCE, STRICT LIABILITY, STATUTE, OR OTHERWISE, AND EVEN IF A PARTY WAS ADVISED THAT DAMAGES WERE POSSIBLE.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
23. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless First Choice Peptides and its owners, officers, directors, employees, contractors, agents, affiliates, suppliers, licensors, successors, and assigns from claims, demands, investigations, proceedings, damages, judgments, settlements, penalties, fines, liabilities, losses, and reasonable attorneys’ fees and costs arising out of or relating to:
- Your violation of these Terms;
- Your unlawful, unauthorized, negligent, or improper conduct;
- Your possession, storage, handling, transfer, distribution, disposal, use, or misuse of a product;
- Human or animal administration, ingestion, injection, application, or consumption involving a product;
- Injury, illness, death, property damage, contamination, or loss caused by your actions or omissions;
- Statements, claims, advice, dosing information, testimonials, advertisements, or promotional content you create or distribute;
- Your affiliate or referral activities;
- Your violation of applicable law;
- Your violation of another person’s privacy, intellectual-property, contractual, or other rights; or
- A regulatory inquiry, investigation, or enforcement action caused by your conduct.
We may assume control of the defense of a matter subject to indemnification. You agree to cooperate reasonably and not settle a covered matter in a manner that imposes liability or obligations on an indemnified party without our prior written consent.
This section survives termination of these Terms.
24. Informal Dispute Resolution
Before initiating arbitration or litigation, the complaining party must send the other party a written notice describing:
- The party’s name and contact information;
- The facts giving rise to the dispute;
- The legal or contractual basis of the claim; and
- The specific relief requested.
Notices to First Choice Peptides must be sent to: support@firstchoicepeptides.com
The parties will attempt in good faith to resolve the dispute informally for at least thirty (30) days after receipt of a complete notice.
This requirement does not prevent either party from seeking emergency relief where delay would cause immediate and irreparable harm.
25. Binding Individual Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO HAVE A DISPUTE DECIDED BY A COURT OR JURY.
Except for matters expressly excluded below, any dispute, claim, or controversy arising out of or relating to these Terms, the Website, the Services, communications, an order, a product, or your relationship with First Choice Peptides will be resolved through final and binding arbitration on an individual basis.
The arbitration will be administered by the American Arbitration Association (“AAA”) under the AAA Consumer Arbitration Rules then in effect, as modified by these Terms.
The Federal Arbitration Act will govern the interpretation and enforcement of this arbitration agreement.
A single neutral arbitrator will conduct the arbitration. The arbitrator may award the same individual remedies that would be available in court, subject to these Terms and applicable law.
Unless the parties agree otherwise, hearings may be conducted remotely, through written submissions, or at a reasonably accessible location consistent with the applicable AAA rules and law.
Arbitration fees will be allocated according to the applicable AAA Consumer Arbitration Rules, except that First Choice Peptides will bear any additional amount required for this arbitration provision to be enforceable.
Arbitration Exceptions
Either party may:
- Bring an eligible individual claim in small-claims court;
- Seek temporary or emergency injunctive relief from a court to prevent immediate and irreparable harm;
- Seek relief concerning infringement or misuse of intellectual-property rights; or
- Pursue a claim that applicable law prohibits from being arbitrated.
Arbitration Opt-Out
You may opt out of this arbitration agreement by emailing support@firstchoicepeptides.com within thirty (30) days after first accepting these Terms.
Your opt-out notice must include:
- Your full name;
- The email address associated with your account or order;
- A clear statement that you are opting out of the arbitration agreement; and
- The date of your request.
Opting out of arbitration will not affect the remaining provisions of these Terms.
26. Class-Action and Jury-Trial Waivers
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND FIRST CHOICE PEPTIDES AGREE THAT CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF, CLASS MEMBER, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE IN A CLASS, COLLECTIVE, CONSOLIDATED, COORDINATED, OR REPRESENTATIVE PROCEEDING.
THE ARBITRATOR MAY AWARD RELIEF ONLY TO THE INDIVIDUAL PARTY SEEKING RELIEF AND ONLY TO THE EXTENT NECESSARY TO RESOLVE THAT PARTY’S INDIVIDUAL CLAIM.
WHERE A DISPUTE IS PERMITTED TO PROCEED IN COURT, YOU AND FIRST CHOICE PEPTIDES WAIVE THE RIGHT TO A JURY TRIAL TO THE FULLEST EXTENT PERMITTED BY LAW.
If a court determines that a particular claim or request for relief cannot lawfully be subject to the class-action waiver, that claim or request will proceed in court only after all arbitrable matters have been resolved, unless applicable law requires otherwise.
27. Governing Law and Court Venue
These Terms and any dispute not subject to arbitration are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except that the Federal Arbitration Act governs the arbitration provisions.
Subject to the arbitration and small-claims provisions above, any permitted court proceeding must be brought in a state or federal court located in the Florida county in which First Choice Peptides maintains its principal place of business, unless applicable law requires another venue.
You consent to the personal jurisdiction of those courts and waive objections to venue or inconvenient forum to the fullest extent permitted by law.

This section does not excuse payment obligations already incurred.
